A good friend of mine was recently attacked at a house party by a guy who was considerably larger than him. The other guy got my buddy on the ground and starting throwing blows, and then proceeded to pull out a knife and start stabbing my friend. My friend managed to block most of the stabs but still got sliced up good. Meanwhile the guy was still on top of him and attacking, my friend managed to get the knife away and in a state of shock and panic he stabbed back a number of times and killed the guy. Shocked The police just charged him with 2nd degree murder. He is now looking at 15 years. I personally think that is bullshit, I would have done the same thing, and plus the other guy was hardcore juicing it ( Steroids).
I was just wondering what other peoples opinions are on this type of a situation ? What if someone was really trying to kill you, and you did what you could to save your life and ended up in jail ?
Also is anybody familiar with the self defense laws is Canada with this type of situation ?

Did you know that in Canada, if you are caught in the possession of pepper spray, you can go to jail for 10 years !

In Canada, you are forbidden to use force to defend yourself. I don't mean just guns here. ANY weapon is against the law, be it a baseball bat, a knife, pepper spray, tasers, chair leg, rope, toilet siphon etc. Any object you can use. Even if you use Frozen Meat or a Frozen Pizza to hit an attacker.

In Canada, if you use a Taser in legitimate self-defense, you can be charged for the use of an illegal prohibited weapon and go to jail for 10 years.

Even though the person you Tased is in perfectly good health. Chances are YOU are the one who will get a tougher sentence because you had the Taser and your attacker who threatened your life will walk away a free man even if he attempted murder on you.

THIS IS CANADA. IS THIS RIGHT ?

People often cite instances where a person is "charged" or "sued" as evidence that "the laws are absurd".

This simply makes no sense. No laws regarding assault, manslaughter, or self-defence have been applied here yet--that will be done by a judge. Only laws regarding powers of the police have been applied here, and as far as I can see, they've been applied properly. If they have good reason to believe that a crime has been committed, they're not supposed to just evaluate the situation on the spot and say, "naw, this looks like self-defence". Someone just stabbed another person a whole bunch of times... until the guy died... and they have to do their due diligence.

Suppose you were a friend or family member of the person who was killed, not the guy defending himself? If the cops said to you, "We didn't charge the guy because it was obviously self-defence," what would your reaction be? Obviously, these things have to be sorted out in court.

It's a stressful, sucky situation, but if your friend retains good counsel and was in the right, chances are he'll come out fine.

You are VERY mistaken regarding the facts of the law. A person who uses a weapon in self-defence CAN be vindicated under the self-defence statutes in the Criminal Code. It depends on the facts of the situation.

Google "criminal code canada" and search search for the sections on assault, homicide, and self-defence. Then google "Ted Truscott" and read his articles and books.

The government has gone to a lot of trouble to make the law accessible and comprehensible to its citizens. The least you could do is read the damn thing before you whine and bitch.
