Back in March of this year a neighbor came into our home stomping and kicking on the door because the music was allegibly too loud. My dad (who wears glasses and has many heart conditions and lives on a daily basis on constant medications) came to answer and the guy step inside and pushed him while yelling at him. My sister (who was 17 at the time) went foward and he grabbed her face and pushed her. I got him out of the apartment and punched him 3 times. A relative grabbed me and the guy left. I went after him to follow him in case he went to get a weapon or call someone. By the time I saw him in the lobby he was all bloody. He fell down the stairs. His wrist was broken and he received staples on the back of the head. But he said I did it to him when he obviously feel down the stairs. I'm not a violent person and I never hurted anyone before but when I saw my dad on his knees holding his chest it broke my heart. The cops saw the bloody mess and didn't arrest me because they said it was a debatable self defense. He pressed charges and 3 days later I was brought up to the police station to be arrested for a 3rd degree felony as a battery. A month before this happened I received a letter from Columbia University stating I got accepted, University of Florida accepted me a month later. After these charges were issued both schools froze my status and denied my application until a veredict was given. I had to find another job since as soon as my supervisor found out he's been trying to cut my hours, even with my extended resume (honors AA degree with difficult courses, 4 years in the US Marines, etc) I cannot be hired because I have an arrest of a felony on my record (even though I have not been convicted) so I need to work like an illegal immigrant (I work as valet all night long at a club from 11pm till 6am). I went overseas and I'll never regret it, I LOVE this country, we were told we were doing it all for freedom, democracy and justice. We were defending our nation. I find it so ironic now. I've lost faith in our judicial system that guy is doing whatever he wants with my life since the charges are not being dropped. My public defendant is trying to get me PTI but the accuser won't agree. WHAT SHOULD I DO? I WANT MY LIFE BACK. I FEEL LIKE I SHOULD NEVER PROTECT MYSELF OR OTHER EVER AGAIN! _________________ Semper Fidelis! |

| My questions are: why hasn't your father filed an assault and battery charge against this guy? Why hasn't your sister filed an assault and battery charge against this guy? Why haven't they each filed a civil suit against him?Why haven't you filed a civil suit against him for damages received as a consequence of his attacks? Why have you not encouraged the apartment complex to file suit against him...or else you will sue them, I mean,it did happen on THEIR property and they did rent to him. I am very sure that when all these things are done he will change his mind.Now he will be forced to retain an attorney,this will cost him EVEN if you all drop the charges,which I wouldn't.BTW,let it go to trial,they will have to PROVE battery and the court will want this to be pled out outside of the courtroom.DON'T DO IT! GO TO TRIAL! It will be much more difficult to find you guilty...too much will have to be brought out(like other violent episodes he's had?)Go on the offensive. |

It really sucks that the cops and the state attorney’s all have this way of listening to the attackers in cases like this...treating them like victims when they get their butts kicks for attacking someone....
When it comes to using a firearm to defend yourself this is why the concealed carry instructors and most cops off the record will tell you...
"If you ever have to use a gun to defend yourself, you better kill the attacker" Because they can run around and make up any lie they wish while your told to be silent by attorney’s…
Good luck, Maybe you will come by a State attorney with some common sence. |

We agree with JackAubrey and Muddfish. Terrible situtation. Don't stop fighting for others that can't defend themselves. It would be worse to live with that your sister was raped, beaten, killed etc...or if your dad suffered an attack from someone else that you could of stopped.

Keep some perspective. Jail time is better than your family being killed or seriously injured because you did nothing.
It looks like you caused a lot of your own problems though. You got him out of the apartment and then punched him. If you got him outside then why didn't you go back in and shut your door and lock it? That looks bad. Then after punching him you chase after him instead of returning to your apartment. That looks worse. After the immediate danger was over you should have immediately called the police. That would have made you look like the victim whereas chasing after him makes you look like the aggressor. |
