Hi,

I'm in California, USA, and wondered if the brandishing and use of a knife in a fight exacted a more severe penalty than using a baton. Is that true? Supposedly it is more life-threatening to stab someone than to break his bones?

I suppose too there's the factor of bloodletting. You can lose a lot more blood from a stab wound...and maybe die?

However, if the possible penalty is the same I would sooner go for the knife.

Anyway, a friend of mine swears that cops are "way more" understanding of baton use than a knife. But I don't think that's true.

Knife is much more lethal. You talk about "bone-breaking"... but you can beat a guy down with a baton quite a bit without fracturing anything. The extendable baton was designed as a weapon of less lethality, and proper use involves striking the muscle groups adjacent to the long bones of the body.

You can't use a knife effectively without causing serious harm, and some risk of fatality.

true, I wouldn't mind getting a expandable baton but don't know where to go look.

This is a strange question really. Knives are looked down upon because their pierce flesh and have a more obvious harmful effect. Batons are just sticks really and do not seem as harmful.

In principle the law looks primarily at how the weapon is being used--WHAT YOU'RE DOING WITH IT, and whether that's proportional and appropriate.

Whipping out the knife means embracing a higher level of force, more potential for injury and so on. But if you're using excessive force with a baton you're still asking for trouble. Hell, in many places, trained guys can get charged with "assault with a deadly weapon" for stuff they do unarmed. They're using their hands AS deadly weapons by virtue of the intensity of their attack. Truscott can speak to this better than I can, of course.

You can get in trouble for almost anything these days. I know batons are less deadly, but to left-wing lawyers they are still a weapon. Good luck to us all.

In California, collapsible batons are considered illegal, but tactical folders are not (Snoop Dog got busted for carrying a collapsible baton here at our airport in Orange County).

At the same time, the knife is considered a "deadly weapon" while a baton is not.

I've said this elsewhere, but I'll repeat myself. I have a tactical folder and I have a kubotan. I keep the tactical folder in my vehicle, I keep the kubotan on my keychain where I have easy access to it and can have it pre-deployed in my hand as I walk out to my vehicle. Or I could grip it in my pocket wherever I am if I felt there might be a problem and could still deploy it quickly. This is something you can't do with a collapsible baton or knife.

Because it's easier to deploy, and because legally the kubotan is considered "less-than-lethal" and a knife is not, I prefer it to my tactical folder for carrying.

Whatever you carry, think about the ease with which it can be deployed before you rely on it.
